Protected Statuses under U.S. Immigration Law

Many individuals have come to the U.S. due to the threat of persecution in their home countries. Eligibility for asylum or refugee status is granted if someone can prove they are being persecuted because of their race, religion, nationality, social group, or political opinion.

Specific immigration statuses that apply to this situation include:

• Asylum, for individuals who have already entered the U.S.; asylum can be granted regardless of your current immigration status or how you entered the country

• Refugee status, for individuals who remain outside the U.S. but are afraid to return to their home country because of the threat of persecution

• Temporary protected status, for foreign nationals who have entered the U.S. due to unsafe or dangerous conditions in their home countries, such as natural disasters, political uprisings, or war
   

Those who wish to seek asylum must apply for it within one year of entering the United States and may continue to live here while the application is processed. In general, individuals seeking asylum are not permitted to work.

Refugees must be eligible and be referred by the U.S. Refugee Admissions Program. Admission as a refugee is decided on a case-by-case basis through interviews with immigration officials.
